Cosmetic Product labeling

The packaging and labels that must appear on Canadian cosmetics are pursuant to the Food and Drug Act (FDA), Cosmetic Regulations, Consumer Packaging and Labeling Act, and Consumer Packaging and Labeling Regulations ( Consumer Packaging and Labeling) are subject to complex regulations and influences. The general premise of the label regulation is simultaneous labeling in English and French, but depending on the content being labeled, there are parts that only allow labeling in one language, so careful attention is required.

The essential information that must be included on cosmetic labels is listed below.

  • Product identity - written in both English and French for lotions, shampoos, etc. (Except for cases where the identity of the cosmetics is clear, e.g. lipstick)

  • Net quantity - expressed in metric units (e.g. mL, g, etc.), may be written in English only.

  • Name and address of the manufacturer - Include address, website, email, etc. where consumers can contact you. If it is an imported product, indicate the address of the overseas business, Canadian seller (imported by, imported for), country of origin, etc.

  • Precautions and safe use (avoidable hazards and cautions) - described in the Caution section

  • Ingredients - When indicated as INCI, they can be written only in English. They must be included on the external packaging label, but do not need to be written on the internal label (must be visible to the consumer at the time of purchase).

October 2024 Updates (Updated)

The Canadian government has announced changes to the cosmetic notification form in line with the revision of public cosmetic ingredient regulations. These updates took effect on October 18, 2024, and aim to enhance consumer safety and transparency. The key changes are as follows:

Key Changes:

1. Section 2 – Product:

  • A new field for “Product Type” has been added. It is now mandatory to specify whether the product is a rinse-off or leave-on product.

  • Note: If the product is intended for use on the skin, the application area must be clearly indicated.

2. Section 3 – Notifier:

  • The notifier can be a manufacturer, importer, or a representative. All notifications from Health Canada will be directed to the listed notifier.

3. Section 4 – Manufacturer and Label Contact:

  • This section has been updated to include manufacturer and brand representative details.

  • In the future, a Canadian address may be required to complete the submission. This requirement is expected to be enforced at a later stage.

4. Section 5 – Product Ingredients:

  • INCI (International Nomenclature of Cosmetic Ingredients) is now mandatory. If no INCI name exists, the chemical name must be indicated.

  • A new field has been added to input the exact concentration of active ingredients, reflecting the updated scope of the regulation.

  • If restricted substances are included, you must submit the product’s label text. (e.g., when ingredients like TALC are present)

5. Section 8 – Declaration:

  • A new declaration field has been added, requiring a statement that the submitted information is accurate, up-to-date, and complete.

  • A signature field has also been added, and the signer's name must match the contact listed in the Notifier section.

🔺 Important Note:
A key area to pay special attention to in this revision is Section 4 – Manufacturer and Label Contact.
Previously, even manufacturers outside Canada (including Korea) could register using only their foreign contact information.
Under the updated regulation, a Canadian address and contact information must be included.
